President Joko Widodo, widely known as Jokowi, has recently issued Government Regulation (PP) No. 26/2023, focusing on the comprehensive management of sea sedimentation. This regulation encompasses essential provisions for the utilization of sea sand and other sediment materials, with a specific emphasis on their potential for exportation.

The primary objective of this regulation is to foster sustainable development and facilitate the much-needed rehabilitation of coastal and marine ecosystems.

Enacted on the 15th of May 2023, this policy seeks to address the critical issue of sedimentation, which poses significant threats to the coastal and marine environments by undermining their capacity to support life and maintain ecological balance. By effectively managing sedimentation, the government aims to ensure the long-term resilience and health of these vital ecosystems.

The regulation acknowledges that marine sedimentation, such as sea sand and mud, can be harnessed for various purposes. Notably, it highlights the importance of utilizing these resources for domestic reclamation projects, government infrastructure development initiatives, and the enhancement of public facilities by relevant stakeholders. Furthermore, the regulation permits the exportation of sea sand, provided that the domestic demand has been met and all legal requirements are adhered to.

To ensure responsible and sustainable utilization, the regulation stipulates that the utilization of marine sedimentation, particularly mud, for coastal and marine rehabilitation should be carefully planned and carried out at designated locations. This emphasis on strategic implementation aligns with the government’s commitment to safeguarding the integrity and effectiveness of rehabilitation efforts.

It is important to note that the utilization of marine sedimentation necessitates obtaining the appropriate permit for sea sand utilization. This permit encompasses various activities, including extraction, transportation, placement, utilization, and potential sale of the sedimentation materials. Additionally, for the sale of sea sand, the regulation mandates the acquisition of a mining business permit specifically issued by the Minister responsible for mineral and coal affairs or the respective Governor.

Furthermore, the regulation emphasizes the need for transparency and monitoring throughout the transportation process. Parties involved in the transportation of marine sedimentation are required to report the volume of sedimentation transported and allow monitoring officers to be present on board vessels. This measure aims to ensure compliance with regulations and promote responsible practices in the utilization of marine resources.

The policy highlights the natural formation of marine sedimentation through weathering and erosion processes, which are influenced by oceanographic dynamics and subsequently deposited. These sedimentation materials encompass a diverse range, including gravel, sand, and mud, which hold significant potential for various applications.

In addition to the ecological benefits, the regulation recognizes the economic advantages associated with the utilization of marine sedimentation. It highlights the utilization of sedimentation resources for domestic reclamation projects, government infrastructure development initiatives, such as National Strategic Projects, and the improvement of domestic facilities by business entities. Furthermore, the exportation of these resources is allowed, given that the domestic demand is sufficiently met, thereby fostering economic growth and enhancing the value chain for local communities.

Overall, the issuance of Government Regulation No. 26/2023 signifies the government’s commitment to managing sedimentation in the sea effectively. By implementing comprehensive regulations and guidelines, the government aims to safeguard coastal and marine ecosystems, promote sustainable development, and create economic opportunities for various stakeholders.
