Did you know that YouTube content can be used as bank guarantees in Indonesia? This is stated in Government Regulation (PP) Number 24 of 2022 concerning the Creative Economy. The PP was promulgated on July 12, 2022. This rule is valid for 1 year from the date of promulgation, meaning it will take effect in July this year. Check out the following requirements!
With this regulation, YouTube content creators with a large number of subscribers can borrow loans from non-bank institutions and intellectual property-based banking institutions.
Several conditions must be met by the creators. One of the conditions is that creative business actors must have intellectual property certificates.
Other conditions include having a creative economy business financing proposal and having an agreement related to the intellectual property of creative economy products.
Furthermore, in PP No. 24 of 2022 article 10, intellectual property that can be used as collateral for debt must meet two conditions.
First, the intellectual property has been recorded or registered with the ministry that administers government affairs in the field of law. Second, intellectual property has been managed either independently, and/or its rights have been transferred to other parties.
In addition, this PP also regulates how to measure debt guarantees. In Article 9 Paragraph 1 of the PP, it is explained, in the implementation of intellectual property-based financing schemes, bank and non-bank financial institutions use intellectual property as the object of debt guarantees.
The object of debt guarantees is explained in more detail in Article 9 Paragraph 2 covering (a) fiduciary guarantees on intellectual property, (b) contracts in creative economic activities, and/or (c) rights to claim in creative economic activities.
