Smoking Inappropriately Will Be Fined IDR 250 Thousand

The DKI Jakarta Regional Government has confirmed that it will fine people who are smoking outside the designated area. Later, people who violate the rule will be fined a maximum of IDR 250 thousand.

This was confirmed by the Head of the DKI Jakarta Yankumham Division, Ronald Lumbuun, quoted on Friday (29/7/2022). He stated, “That’s right. The threat of a fine is contained in the Draft Regional Regulation (The Raperda) for the No Smoking Areas of DKI Jakarta which we have harmonized.”

Raperda is a draft regional regulation that can be proposed by the DPRD or regional heads. In the Raperda concerning smoking rules, it is stated that there are two types of sanctions that can be given to violators, namely fines or social work sanctions.

The following is the sound of the draft Raperda:
Everyone who smokes in the Non-Smoking Area is subject to administrative sanctions in the form of a fine of Rp. 250,000.00 (two hundred and fifty thousand rupiahs); and/or social work sanctions that can be implemented on the spot.

Everyone who advertises promotes, sponsors, sells, and/or buys cigarettes in a No Smoking Area as referred to in paragraph (2) shall be subject to an administrative fine of Rp. 1,000,000.00 (one million rupiah).

Everyone who advertises, promotes, and sponsors cigarettes in the Province as referred to in Article 17 paragraph (4) is subject to an administrative fine of Rp. 50,000,000.00 (fifty million rupiahs).

Anyone who displays or displays the types and products of cigarettes in public places who have a license to sell cigarettes as referred to in Article 17 paragraph (5) shall be subject to an administrative fine of Rp. 10,000,000.00 (ten million rupiahs).

If successfully passed, this new regulation will strengthen the previous rule regarding the prohibition of indiscriminate smoking.

Because, so far, according to DKI Jakarta Governor Regulation No. 88 of 2010 signed by Governor Fauzi Bowo, the owner of a place that does not provide a special smoking room will be subject to administrative sanctions. But for those who smoke indiscriminately, are not penalized.

In fact, said Ronald, a smoke-free area is the responsibility of all components of the nation, both individuals, and communities, to government and non-government institutions.

Therefore, stricter regulations are needed to protect health and the right to a healthier environment.
