Foreigner Getting Sentenced for Faking Marriage Certificate

    The North Jakarta District Court (PN Jakut) sentenced Yemeni citizen, M, to 2 years and 9 months in prison.

    The panel decided that Mahmud was proven to have falsified the marriage certificate with the intention of circumventing the immigration administration in the form of a residence permit.

    The Jakut District Court stated that Mahmud was legally and convincingly proven guilty of violating Article 123 letter of Law Number 6 of 2011 concerning Immigration. Namely regarding the giving of false or falsified letters or data or false information on purpose with the intention of obtaining a visa or residence permit for himself.

    “The sentence is in the form of a prison sentence of 2 years and 9 months and a fine of Rp. 300 million subsidiaries of 1 month in prison,” the panel decided as reported by the Case Investigation Information System (SIPP) of the Jakut District Court, Friday (12/11/2021).

    The decision was knocked on Thursday (11/11) with the chairman of the assembly, Hotnar Simarmata. Responding to the decision, the Head of Public Relations and General Affairs of the Directorate General of Immigration, Arya Pradhana Anggakara said he respected it.

    Arya said that this case began when the Immigration Officer of the Central Jakarta Immigration Office was contacted by a member of the Foreigner Monitoring Team (Timpora) at the Yemeni Embassy.

    After checking, it was found that Mahmud’s passport was at the Serang Immigration Office for an application of a status transfer from a family union limited stay permit (ITAS) to a permanent residence permit (ITAP) on 27 October 2020. On the other hand, Mahmud is also listed on the People’s Wanted List (DPO) Sub-Directorate of Investigation of the Directorate General of Immigration.

    Based on the results of the examination, it was found that the foreign marriage was not registered in the KUA register in Tanjung Priok District, North Jakarta. There are several irregularities in the marriage book shown by Mahmud, including the unregistered registration number listed, the writing being done manually by handwritings, hands, and the incompatibility of the KUA stamp and signature of the Head of KUA.
